Terms of Use

These Terms of Use ("Terms") govern your access to and use of the WrenchSpeak mobile application and related services (collectively, the "App"), provided by WrenchSpeak ("we," "us," or "WrenchSpeak"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any device that you own or control, solely for your personal, non-commercial use, in accordance with these Terms and the usage rules of the app store from which you obtained the App. This license does not allow you to use the App on any device you do not own or control, and you may not distribute or make the App available over a network where it could be used by multiple devices at once.

2. Important Safety Disclaimer

WrenchSpeak provides automotive reference information, diagnostic trouble code explanations, repair procedures, torque specifications, and AI-generated guidance for informational purposes only. It is not a substitute for professional mechanical advice, a factory service manual, or a qualified technician.

Vehicle repair and maintenance can be dangerous. Always follow your vehicle manufacturer's official specifications and safety procedures.
Torque values, specifications, procedures, and AI-generated answers may contain errors, omissions, or information that does not apply to your specific vehicle.
You are solely responsible for verifying any information before acting on it and for performing all work safely.
If you are not confident performing a repair, consult a licensed professional.

You assume all risk and responsibility for any work you perform or decisions you make based on information provided by the App.

3. AI-Generated Content

Certain features use third-party artificial intelligence services to generate responses, identify parts from photos, interpret codes, and personalize procedures. AI output may be inaccurate, incomplete, or misleading. Do not rely on AI-generated content as your sole source of truth for any safety-critical task. We make no warranty as to the accuracy or fitness of any AI-generated content.

4. Subscriptions and Payments

The App offers auto-renewable subscriptions (such as DIY Pro and Garage Pro) that unlock premium features.

Billing: Payment is charged to your app store account at confirmation of purchase.
Auto-renewal: Subscriptions automatically renew for the same period unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
Managing/Cancelling: You can manage or cancel your subscription in your app store account settings after purchase. Deleting the App does not cancel your subscription.
Free trials: If a free trial is offered, any unused portion is forfeited when you purchase a subscription. Charges begin when the trial ends unless you cancel beforehand.
Pricing: Prices are shown in the App before purchase and may change with notice. Subscriptions are managed and processed by the applicable app store, not directly by us.

Refunds are handled by the app store under its policies; we generally cannot issue refunds directly.

5. Acceptable Use

You agree not to:

Reverse engineer, decompile, or disassemble the App except as permitted by law;
Use the App for any unlawful purpose or in violation of any applicable regulation;
Interfere with or disrupt the App or its underlying services;
Resell, sublicense, or commercially exploit the App or its content without our written permission.

6. Intellectual Property

The App, including its content, design, text, graphics, and software, is owned by us or our licensors and is protected by intellectual property laws. Except for the license granted above, no rights are transferred to you.

7. Privacy

Your use of the App is also governed by our Privacy Policy, available at https://www.wrenchspeak.com/privacy-policy, which explains what information the App handles and the limited circumstances in which information leaves your device.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR PROPERTY, OR ANY PERSONAL INJURY OR PROPERTY DAMAGE, ARISING FROM OR RELATED TO YOUR USE OF THE APP OR ANY INFORMATION IT PROVIDES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ALL CASES OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR USD $50, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify and hold harmless WrenchSpeak and its affiliates from any claims, damages, or expenses arising from your misuse of the App or violation of these Terms.

11. Third-Party Beneficiary (Apple)

If you obtained the App through the Apple App Store, you acknowledge:

These Terms are between you and us only, not with Apple. Apple is not responsible for the App or its content.
Apple has no obligation to provide maintenance or support for the App.
In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
Apple is not responsible for addressing any claims relating to the App, including product liability, legal/regulatory compliance, or consumer protection claims.
Apple is not responsible for any third-party intellectual property claims relating to the App.
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and is deemed to have accepted the right) to enforce these Terms against you.
You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and that you are not on any U.S. Government list of prohibited or restricted parties.

12. Termination

These Terms remain in effect until terminated. We may suspend or terminate your access if you violate these Terms. Upon termination, your license ends and you must stop using the App.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of Arizona, USA, without regard to conflict-of-law principles, except where app store usage rules or mandatory consumer protection laws apply.
